Stuy Town deal may have sting in store for some

Some residents of the sprawling apartment complex could face substantial rent hikes as a result of Thursday's tentative deal

For residents of Manhattan's sprawling Stuyvesant Town/Peter Cooper Village residential complex the settlement announced late Thursday could have a painful reprocussion. The deal awarded tenants $147 million for rent overcharges, reimbursements and discounts in prior years, but going forward it could push rents substantially.

According to CWCapital, the company that represents the bondholders for the complex's $3 billion mortgage, about 1,800 apartments at the 11,000-unit complex face a choice of two rent options: a market rate, or one calculated based on how many times the apartment was vacated and what increases it is due according to city regulations.

In a surprise contradiction to the widespread belief that rent regulations create discounted apartments, the market rate is in the fact often the cheaper option, according to CWCapital.

"I am concerned about people who had an expectation that their rent had settled at a certain place and may be wholly unprepared for the increases this agreement allows," said Daniel Garodnick, a City Councilman who lives in Stuy Town and has been a tenant advocate.

When a rent-regulated apartment is vacated, it allows rents to be substantially increased, by as much as 20%. The settlement deal allows as many as three such increases dating back to 2003, when apartments first were illegally deregulated at the large complex.

"Let's say that the tenant previous to the market rate occupant paid $1,200 a month," attorney Alexander Schmidt, who represented the tenants in the settlement said. "You could have easily seen three turnovers with the amount of students that live in the complex and rents that now end up in the high $2,000s or low $3,000s, which is market rate or not much lower."

Mr. Schmidt called it an "ironic" end to a case that was largely looked at as a battle for preserving affordability in the city for working class tenants.

HOW IS IT THAT THERE IS NO ENFORCEMENT IN THIS COMPLEX OF THE HOUSING LAW THAT STATES THAT NO MORE THAN 3 UNRELATED PEOPLE CAN OCCUPY AN APARTMENT?

And....

HOW IS IT THAT PARTITIONS AND WALLS CAN BE INSTALLED INTO APARTMENTS TO INCREASE THEIR VACANCY, BUT THAT THOSE APARTMENT BUILDING CODE APPLICATIONS STATE THAT THERE IS NO CHANGE IN OCCUPANCY?

In other words....

WHAT THE FUCK IS GOING ON HERE???

  3. This is a great deal for the lawyers and that's the reason they settled. They could have fought on for years to get more for the tenants they represent but their fee might not have been any larger in the end if they were unsuccessful. They had nothing to lose by suggesting a settlement at this point in the process. If they had continued to fight on on our behalf, it might well have just cost them more without any extra cash in their pocket.

    We can all sleep well knowing that they optimized their return on investment.

  4. The now defunct interim agreement provided for one 20% vacancy rent increase allowance. This so-called "settlement" provides for up to three 20% vacancy rent increase allowances. This is a TOTAL victory for the landlord. The tenants naturally get screwed. The lawyers get 25% of the pie. Met Life, which made THREE BILLION dollars profit when they sold has to pay $10.5million...chump change...boo hoo. Drive another nail in the coffin of affordable housing in Manhattan. Garodnick, Duane, the Tenants Association, the other local pols...ALL LOSERS who talked a big game but ultimately provided NOTHING. Stuy Town is finished as an oasis of green in the madness of the city. How sad! Skating rink anyone? Hahaha...who is laughing now?

  7. The 3 unrelated people not being allowed to live together has been around since the 30s or so and not enforced for just as long. If it was enforced here, the city would have to make an attempt to do it everywhere. It's a toothless law.

  8. The truly ironic thing is that the Court of Appeals said that the landlords impermissibly deregulated the apartments in the Roberts verdict, but in effect that is what the settlement has allowed them to do, which is effectively deregulate the 4000+ Roberts apartments.

    1. Opting out isn't the solution. Even if I got a better deal for me, the real issue is about the nature of the complex going forward. Strategically, it might be better to have a flawed settlement sooner in order to move along conversion talks. That is unless, the deal is so favorable, that CW doesn't feel the need to sell to the tenants or if Sandy has scared off tenants from wanting to buy in. No shortage of intrigue.

    I have a neighbor who was an original tenant in a 3-BR. She just died earlier this month and let's just assume she was paying $1,500/month (which I bet is a high guess. So now, when her aparment is renovated and turned over, under the newly re-regulated status...are we actually saying that somebody is going to be getting a GREAT low-ball deal on their rent?

    I bet the answer will be no, despite what the settlement mandates. In fact, I will now make it my business to prove that the new rent in that apartment will violate the agreement.

  14. Re: the 3BR. This apartment doesn't fall under the settlement. But under the original Roberts decision it is rent-stabilized. So add in a vacancy increase, and $120,000 in renovations. (Articles suggest average renovation over 80K, considering this is a 3BR it's not unreasonable) we're looking at a rent on 3700 or so, which is far less than the 5000K they are going for on the website.
    I would suspect some combination of the 4 strategies.
    1) Find another 60K of renovations, raising the rent to $4700
    2) Hold the apartment for NYU students who after 2-3 vacancies will push the legal rent up to market
    3) Don't renovate or rent the apartment out - hold on until a change in the law or 2020. It's close whether or not the renovations would pay for themselves before 2020.
    4) Rent the apartment out to a close friend of someone who runs the place.

  15. Answer to the 2:36PM poster: If deceased neighbor listed relative as occupant, then said relatice could take over apartment at current rent. Said relative must have been legitimate occupant because Stuy Town will thoroughly investigate.
    If Stuy Town gets control of apt., with 20% vacancy increase, rent goes to $1800 plus increase for bogus improvements...still hard to see how they could reach $2500 threshhold for decontrol....unless they orchestrated phony one-yr. lease turnovers.I wouldn't put ANYTHING beneath these mo' fo's as we used to call them in the 'hood...lol

    What pisses me off is that the TA kept saying they weren't a party to the case and didn't know any details of the negotiations. How is that possible? Who the hell was overseeing the lawyers? Now Dan wants us to support him in his political career? Give me a break, depending on how high my rent goes I'm outta here. Enjoy the the 22 year olds who will carve up my apartment and squeeze in.

    It will depend on how much Management claims on the renovation cost. If they claim (and can prove, although whether anyone will check is debatable) $60,000, they can add only $1,000 (1/60 of the reno cost) to the rent, along with the vacancy allowance. The vacancy allowance can be as much as 20% plus 0.6% per year if the tenant was in the apartment more than 8 years.

    Using your theoretical $1,500 (which might be too low), add 20% (for a 2-year lease) plus about 39% (65 years X 0.6%) plus $1,000 reno cost. That comes to $3,385 by my calculations, unless I'm leaving something out. I guess that is a lowball deal for 3 bedrooms.

  22. "add 20% (for a 2-year lease)": I wasn't clear. If the new tenant chooses a 2-year lease, the vacancy increase is 20%. There's a different percentage for a 1-year lease, depending on the spread between the 1-year and 2-years increases as determined by the RGB.

  23. No Dog area signs should not be replaced until we have access to the basement levels and all of the industrial drying equipment and power generators have been removed. I live on 23rd and always left through the Lower Lobby Level to walk my guys but that is not possible now. Furthermore, my building is surrounded by massive equipment and it's not feasible to go anywhere but onto the "no dog" area across from my building.
    I know most long timers hate dogs/dog owners but give us a break until things are normalized. Please.

  26. I'm thinking the situation people are up in arms about is something like this. In 2009 someone living in a 2BR was making more than 200K per year & the base rent was over 2K per year. So the unit was deregulated and then the person vacated for some reason. Then the unit was rented to students 2x. Then someone else moved in paying a high rent but was expecting a lower rent once Roberts was settled. So in 2009, let's say the rent was 2100. After one turn over: 2520, after two: 3024, after three: 3629. So the market rate is probably around 3200. Do I have this wrong? If not, I don't think there would be many in this situation. And if they're offered the market rate now, they'd probably be paying close to what they signed on to pay when they moved in (which may be a disappointment to them but it's not a bank acct buster as they were originally willing to pay the market rate). So as I see it, the settlement may not have been such a bad deal....although I will say...18MM for 2 law firms for 18 months work off & on...outrageous, but all these stories are par for the course for many law firms.

    Actually, we hate the policy that allowed dogs into the complex. To infer that you are hated is simply bizarre and a bit histrionic. The effects of this misguided policy has been covered ad infinitum so requires no further coverage here.   37. On the topic of dogs, a food delivery man on a bike just rode through some women walking their dogs. I live at 449 and heard this loud shreiking outside my window a few minutes ago. A food delivery man on a bike rode through two women walking their dogs and the leash got caught up in his wheel. When I looked out the window he was on the ground, off his bike, untangling the leash the from his wheel. Luckily the women nor the dogs were hurt too badly. They zip through here like mad men!

    Do you walk your dog in the permitted area around the Oval? Is your dog one of the acceptable breeds to own here?

    Depending on the weather and my work schedule, I spend some time around the Oval, and I never heard any old woman yelling about dogs.

I have never felt threatened by a dog on the complex, but have been almost mowed down by these delivery fiends who come out of nowhere at top speed on the sidewalks and pedestrian paths.   40. Dog owners are obviously well within their rights to own their animals. However, there will always be residents who remember a property that didn't have shit and piss all over it. A home that was extremely quiet (no barking from the apt. next door). Some people will carry resentment toward dog owners because they have these "crazy" ideas about wanting a clean and quiet home. Yes I know that dogs aren't the only reason for the degradation of the QOL around here, but it's what we're talking about right now. As time goes on, and the people who remember this property as a clean one move on, the resentment will disappear because there will be no one left to harbor it. For now, however, dog owners will just have to expect that there will be residents who prefer a home without barking all hours of the night, and shit and piss on the lawns and walkway. I know it's crazy, but try to understand the source of their animosity.

  41. I've lived here 32 years and remember when the property was clean and quiet. Then along came the students and the dorm life they naturally bring with them. That's when I noticed the quality of life corroding with loud noise overnight, puke in the elevators and I have seen the frat boys piss as they drunkenly stagger home. The dogs don't bother me. Sure, there's a few turds here and there, but they may not even be from the dogs that live on the property because people from outside the complex come in to walk their humongous dogs and they don't give a fuck because management and "PS" don't give a fuck. In my opinion, the dogs have played a very, very minimal role in the degradation of the quality of life here; the students and twenty-somethings and the money-clawing, totally incompetent managements we've had here for the past decade are to blame. I have neighbors with dogs, neighbors with screaming kids and students packed in sardine-style. The dogs are the least offensive of the lot.

  43. I was just reading the official PCVST facebook page. Boy, do those paying-through-the nose, multiple-names, young tenants love to complain! Serves management right! We oldsters aren't nearly as demanding and foot-stamping. At least I don't think we are! Not that I blame these young folks for demanding heat, hot water, clean water, etc., especially as they are paying ridiculously high rents to live here. We older tenants are used to substandard conditions when it comes to heat and water, etc., and when we do want something done we don't expect the world to stop turning until it is done! I don't think this new management company is quite up to the job, especially as they have laid off so many workers. Keep on whining, MRers! Give 'em Hell!

And thank you to all the others on this thread who have pointed out that it's the students and 20-nothings who have turned the place into a giant dorm, and are ruining the quality of life here. Sure, there are selfish dog owners, but it's NOTHING compared to the horrific conditions many of us are forced to endure while living above, below and next to these selfish young Yunnies.

    I could be wrong on this, but I don't believe the anti-dog policy people care whether the turd comes out of the ass of a dog from the property or from an outside one. I'm fairly certain that their contention is that when dogs weren't allowed there were NO turds of any kind on the property (local or foreign!). I certainly never saw any. Out side dogs would not be walked on this property if that no dog policy were still in place.

    Having said that, I hope they start allowing four dogs per apartment with no size restrictions. I'm hoping that the conversion goes through so that I can sell (acknowledging that I will probably have to wait several years to avoid penalties) and get the hell out of this project. Whatever will enable me to sell easier I'm all for. I had a good run, but when it's time to go it's time to go. You can keep your dog turds and NYU turds. Scorched earth all the way.

    Do you think anybody would want to buy your or anybody else's apartment if that happened? Stuyvesant Town would be an even less desirable place than it is now and nobody with half a brain would waste their money on buying a unit here. Unless, of course, it was NYU.

  50. Yes, 11:21, please leave! You sound like poison! If you hate it here that much you are totally wasting your life. I am a market rate tenant and only pay the high rent because I love it here. People like you will drive people like me out and it will be just a dorm and nothing else after we've gone and the older tenants have died off. In spite of the stupid gimmicks the various misguided management companies have put into place which, in my opinion, are a waste of money and appeal to very few, this is still a beautiful place to live. Where else in New York City can you look out your window and see beautiful trees, birds, squirrels and grass - unless, of course, you pitch a tent in Central Park? Unless they pave it over more and cut down more trees for no good reason, I am willing (and fortunately, able) to pay to live here and enjoy the beauty of the Oasis in the City. I have the greatest respect for my older neighbors and don't resent the fact that they pay a lot less than I do. I wish I had their rent level, but I don't begrudge them! They helped make this place the tranquil place that it is and I don't blame for complaining about the loss of a great deal of that beauty and tranquility. If I had students living adjacent to me, I would probably sue for deprivation of acceptable habitability because everybody is entitled legally to the quiet enjoyment of their home. I can't understand why management can't grasp that concept. By the way, I have area rugs and I turned down an apartment with those hideous dark floors even though it was a tad cheaper than the one I finally took. I take off my shoes when I get in so I don't disturb people downstairs when I walk on my uncarpeted areas. I don't understand why other tenants can't grasp that concept!

    Don't forget that a chunk of their rent, let's say $1,000, goes to cover the cost of the reno. Once you subtract that, a lot less is left to cover the expenses.

    (For anyone who questions the $1,000 figure: Before the new rent law of 2011, landlords could charge 1/40 of the cost of a reno. I'm estimating a $40,000 reno cost, which is not unreasonable or at least not unlikely to have been what the landlord claimed.)

  56. You got that right, 8:07 pm! This management has cut staff to the bone, but has all the money they need for commercial events and advertising. Can't get any repairs done, but the skating rink is up and running! Can't get a live one on the phone and "security" is a bad joke, but lady Maya's dumbass events and the lousy cafe are all up and running. So sick of these rubes who think they are running the place. They are just running it into the ground and thumbing their noses at tenants.

  57. The young tenants treat this place like a dump! They leave their garbage and recycling in the lobby, they party into the wee hours of the night in their IKEA decorated, pressure wall divided, carpet free dorm apartments. They sit on the stoops in packs of 15 chain smoking and cackling like drunken fools at 4AM. Then urinate and defecate in the hallways s has been documented in the TA's photostream. I've come home and found food containers tossed on the lobby floor with chinese food strewn about. I've even found half a pizza in my elevator. And shall I mention the thongs and condoms scattered across the oval like a debris field of a crashed plane carrying sex offenders???? And what does ST do? REWARD them with food trucks, rock concerts, cheesy cafes and illegally broadcast football games in the oval where they drink like alcoholics, act like apes and throw beer cans into the bushes. Sure, I'll buy into this place!!!!!

  59. Amen, Gracie! Amen! You got that right. I have four students downstairs from me and they never sleep. They play their music and stomp around their uncarpeted apartment (which is a one bedroom with a pressure wall) all night and they act like their shit don't stink. One of my neighbors complained and was greeted with a shrug, a smirk and a "well, this is New York" response. Little bitch!
    Doesn't New York have noise ordinances relating to apartment buildings? I think so. Only a bunch of parentally funded little assholes from Flyoverlandia would have the gall to behave and speak like these little twerps. These students are devaluing the property. They don't belong here. They need to be living in real dorms where the laissez faire suits their lifestyles.

    The damned students have brought PCVST down to the level of a badly run dorm in a third-rate college town. They have no business living here because they are totally unsupervised, don't know how to behave like responsible adults and are a total disgrace. The colleges that send them here should at least provide some kind of supervision. These kids are a reflection of the idiots who raised them and failed as parents because they didn't teach them any kind of moral code or standards of behavior. They are also a reflection of the colleges that will take anything with a pulse and parents with more money than decency. If this trash is the best that NYU, SVA, et al can find then we are doomed.

  70. I was just looking at the list of apartments on the Berdon claims site. Some of them are apartments rented to students. Do the students or colleges get the increased/decreased rents and damages (where applicable)?

    Anyway here is some real news that I think everyone may be interested in. I live in one of the apts that was illegally deregulated according to the lawsuit. I am a market rate renter I've been living here for about 3 years and according to the settlement I overpaid by almost $2500.

    But here is where it gets interesting: under this settlement my "preferential rent" would go up $400!

    Now there is much speculation but this is coming from the part of the site only allowed to potential class members. So I can attest that this settlement is NOT what it seems. I have yet to decide whether or not I will opt out. The new "formula" they use to derive legal and preferential rates is a joke. It's a shame really.
