This main post will deal with some of these issues....
We kinda laugh at the warning "For Residents and Their Guests," but nowadays even that warning or post (take your pick) is being ignored. Management has no one to go around and check that this notice is up, so either it doesn't care or just doesn't know. (It should have someone going around, period.) It is an amusing notice in a lot of ways, but necessary for this place to be properly zoned. It is missing from, say, Five Stuy Cafe, which should have that notice visible, unless the ruling has been dismissed.
This is a post from November 3rd, 2011:
An ice-skating rink is a pretty big straw, but it seems it has had the effect of mobilizing tenants and making both residents and politicians hyper aware of zoning and the commercialization occurring inside Stuyvesant Town. This week's Town & Village carries a front page article, "Garodnick Questions Legality of Commercial Activity in ST/PCV." Though commercial activities have been happening inside the complex since Tishman Speyer took over as owner and manager, though we've seen the Farmer's Market, Food Trucks, tables for Verizon and Zip Car, charges for the Oval "Essentials," etc, make their way into Stuy Town with some push-back from tenants, this ice-skating rink may just have tipped the balance into getting residents finally fed up with the commercialization inside this property. Or perhaps not. To be seen.
The T & V article carries quotes from councilman Garodnick and management's Adam Rose. Garodnick: "People want to make sure it is legal and I am currently exploring that question. There's a lot of concern over the variety of commercial activities, including the food trucks and now an ice rink and the paid storage facilities." Rose contends that "We believe the minor commercial activity in Stuy town such as food trucks and the ice rink are completely legal, and provide additional amenities and attractions to the vast majority of our residents, especially families." While the legality of commercial activities is yet to be determined by the Department of City Planning (I'm not holding my breath), it has to be stated that the "vast majority" of residents are not using any of the amenities being offered at Stuyvesant Town. We're talking about a resident population of anywhere from 25K to 30K, and certainly you don't even see a tenth of that number using the Oval Essentials, the food trucks, etc, or attending the summer concerts and events, which, at best and on rarer occasions, can draw in a few hundred people.
It can't be stressed enough in these discussions (even T & V skips this point) that these amenities are being used to sell the place to prospective renters, and it must be admitted that some amenities are directed at prospective renters with families, which is a good thing, as we'd like to increase a more stable population rather than the transient student one we see continually growing.
The T & V article reveals more of what Garodnick asked of the Department of City Planning: "Does zoning allow for food trucks to be positioned within the Stuyvesant Town Oval? Management recently announced that they would be installing and opening an ice rink in a Stuyvesant Town Playground. Does the present zoning allow for an ice rink on the property? And if so, would charging for admission or equipment change that?" These are pivotal questions.
Garodnick also stated to T & V that he believes the ice-rink should be complimentary to residents. "An hour a day in a playground that is normally open and free is not a good policy and it will not have a good outcome." Dan must be really hopping mad now, as the updated schedule for free use of the ice-rink allows for just two hours of free use to residents per week, not the previously publicized seven hours per week. (Perhaps I'm wrong, but I smell a slight set-up here, with a "generous" gesture forthcoming that will go back to the one free hour a day schedule.)
A bulging letters column in T & V contains responses from tenants. A couple of tenants are for it, including a familiar voice who calls the rink's detractors "cranky" and "better suited to a gated community in Florida than apartment living in a dense urban environment."
Other letter writers share their concerns, which have also been addressed repeatedly on this blog and Lux's website and Facebook.
The heart-warming surprise comes from an opinion piece by Steven Sanders, who had been our state assemblyman for 28 years. As someone who grew up in Stuy Town, Sanders takes a nostalgic journey in his piece, writing about Playground 10.... "Every kid growing up in Stuy Town or Peter Cooper had 'their' playround and #10 was mine." His article is well worth reading as giving insight into what that playground means and meant. He begins to finish it off this way:
"There are just some places, which are just really special, that corporate America, in such a hurry to make a buck, just does not really get." And: "I may be entirely wrong but I am not sure that there has been an outcry from the residents demanding an ice skating rink which is a very specialized activity that only a relatively few will participate in." Finally:
"When Tishman Speyer bought this community five years ago and over spent literally billions of dollars, they did so in the belief that they could make big changes to our already successful and iconic community that would make it more profitable. In hindsight I am sure they wish that they would have just let well enough alone. So a word to CW Capital and Rose management... 'If it ain't broke don't fix it.'"

STATEMENT FROM COUNCIL MEMBER DAN GARODNICK
Re: Commercial Activity in Stuyvesant Town
The
Department of City Planning (DCP) has responded to the questions I
posed to them about commercial activities in Stuyvesant Town.
With
regard to the planned ice skating rink, DCP has advised that, due to
“the unusualness of this circumstance,” we should seek the review of the
Department of Buildings (DOB), which enforces zoning regulations. My
office has already reached out to the DOB for a final word on whether
an ice skating rink, for a fee, conforms to the R7-2 zoning regulation
applicable in Stuyvesant Town.
Further,
I have asked the DOB for a complete review of the construction permits
and the work that is actively being performed – including the electrical
wires being strung through trees – to ensure that any construction
activity is being conducted without risk to residents or workers, and
within appropriate hours of the day. We expect the appropriate enforcement of any violations.
I
have also asked the Department of Environmental Protection to conduct a
test of the sound that will be emitted from various ice machines in
order to ensure compliance with the noise code, and to confirm the
safety of chemicals that appear to be used in connection with the rink.
With
regard to other commercial activities – such as food trucks and
greenmarkets – that are not permitted in an R7-2 residential zone, we
expect CW Capital/Rose Associates to bring themselves into compliance
with the law. I am happy to offer
the assistance of my office in helping to relocate the Stuyvesant Town
Greenmarket to an area around the property that would be both legal and
convenient for the many residents who enjoy making use of it.
Residents
who want to know what you can do to expedite enforcement on the ice
rink or any other issue are advised to call 311 and to contact my office
with your 311 reference number which will be helpful to us in following
up. Residents should also feel free to contact my office at (212) 818-0580 with questions or concerns on any of these matters.

There is ZERO vetting of who is attending the concerts, the movies, etc. Blackstone should be taken to task on this issue. If it’s not checking IDs and denying access to outsiders, it can NOT rightfully claim that these events are only attended by “residents and their guests”. Which makes them ILLEGAL under our zoning laws.

Everything here is illegal. The Airbnb hotels, the dorms, the sublets, and yes the Bloomberg bermuda yacht club docks all here to push out the permanent community. Mike Bloomberg and Bill De Blasio stole the property for Mike Bloomberg's yacht club pals to have a luxury hotel built here with a front yacht dock that Garodnick is too afraid to tell the tenants about so they say it is for commuters. The real assholes gaming the system are the property managers with tenant association board running the airbnbs, dorms, and sublets.

And, once again, I was driven out of the Oval this morning. Sitting quietly, I was, when a young woman comes next to me and her dog takes a crap, not five feet away. She has the entire length of the Oval for her dog to take a crap, but, of course, he is KING, so he craps where he want to. Now, there is something known as "human decency" where your dog does not take a crap so close to someone who is sitting quietly, hoping to enjoy the nice morning weather. But, no.
And yesterday.... This was funny, in a sort of way. As I was heading out of Stuy Town, I am in back of a lady with a dog. Of course, the dog does not have that official lanyard. Well, I didn't have to follow her to see that she proceeded to head out of the complex and to wherever she calls home. No PS stopped or "escorted" her and her dog off the property.
I see this every day. No PS to escort many of the dog walkers from outside out of the complex. This is one of the MAJOR lies of Management. There is NO escorting done, there is NO word said by PS. Total BS from Management and PS.
The question becomes: how do we, the residents, enforce the rule, or any rule. Is Blackstone in charge totally? Even to the point of ignoring their own rule? The evidence clearly states that rules are meant to be ignored. Oh, yes, it is nice if they are obeyed, but if they are not--who cares?

The only time that the Oval was quiet and peaceful was pre-Tishman Speyer, when it was not considered "a great resource" for making money. After TS and including the managers who followed, the prime objective is to make money and attract new renters. That is the truth.

ReplyDeleteRe last night’s concert, I was there. The 300# is a lie. The # was around 120, tops, and that included children. Also, SPS has lied to us, they said that the volume of these concerts would not be intrusive but they have double downed and made them loud again. Also, no ID’s were checked, therefore this is a commercial event, in violation of the NYC zoning law which classifies the interior of ST as R7-2, a residential zone. On my own, I have left the TA FB page. I will communicate going forward via this blog and the STPC Tenants (not TA) FB page. As I have said before to the cheerleaders, please give me your apartment number and address so that I may come by and blast my choice in music and movies directly at your front door with an 80’s style boom box. I have forwarded 2 photos plus a vid of last night’s concert to the STR, here’s hoping that he will post.

ReplyDeleteI just saw the video and the photos. Astounding (truly) that anyone would think that there are 300 people there or that the place was "packed."
Know too, that there are people on the grass and certainly on the benches..well, because they want to enjoy the Oval for what it is. They are NOT there for the music or the films. You can find me sometimes at the Oval, too. It's nice to read or just sit there taking in the weather, if the weather is nice. If there is music or a film, I'm chased away, as I am looking for peace and quiet, mainly.
I will try to post the above later. I have to go someplace and will be back nighttime.
Sorry, but it still gets to me that some cheerleaders are blatantly lying. Blatantly. Photos and videos do not lie, unless a landlord tweaks them to make the property look good, as I've already proven.

ReplyDeleteThe "music" at Five Stuy Cafe was pretty loud. I believe it was speaker spread out so that everyone could hear it, no matter where they sat at the Oval. I was returning from "the city" and stopped by Associated to pick up some food. Usually, afterward, I sit at one of the Oval benches and relax for a few moments. Couldn't do it. The "music" ("Piano Man") was heard even on the other side of the Oval.

ReplyDeleteThe only people who attend these events are the losers who don't have any kind of life and have to have everything laid on for them, even if it is second rate and crappy. Don't know what kind of people they are, but I know longtime tenants who are in their 80s and 90s who cringe at the thought of attending these events. They have season tickets to the venues at Lincoln Center. The losers who attend these lame concerts and movies probably have never heard of Lincoln Center or any of the other meccas of enjoyable entertainment in this dynamic city. They bring their kids (who don't give a shit about what is going on in the Oval) because they are too busy/lazy/ to do otherwise. It's just an excuse to ignore the kids and drink box wine and pretend they are at a real "event."

If you take your kids to these events for pure convenience, you are lazy. If you can’t afford events at those other places, you shouldn’t be paying $5k to live here. Pay $3k and save the $2k a month to attend events in this great city and go on great vacations.
These are the same parents who will complain when little Billy doesn’t get into a top HS because the competition attended events at Lincoln Center and little Billy was attending concerts in the oval.

Some of us are well informed about some of the myriad illegalities perpetrated by the "landlords."
Powers and Epstein need to hear from more of us, repeatedly and frequently. So do Gail Brewer, Chuck Schumer, Carolyn Maloney, and other politicians. Yes, I know - sell-outs, corrupt, money/power hungry and allied with the Real Estate Board of New York, metaphorically sleeping with each other.
But, hey - ya' never know, do ya?
Even Donald Trump. Why not? Who knows who or what might do the right, moral, legal, and even righteous thing for a change?
I suggest that we look into our own legal action at this point, IN ADDITION to contacting our "elected officials" as someone put it. And, as I've written before, there are plenty of other independent actions we can take.

Unfortunately there is not much we can do. Some of us have contacted and met with our councilman. So far that has not borne any results .

ReplyDeleteIf we become quiet, then the other side wins by default. They could win, regardless, but we won't be a party to that.
Remember when no dogs were allowed here? Once they came the place started to deteriorate accordingly. Barking through the thin walls, dog owners "walking" their dogs while their owners ignored them,at all hours, under apt. windows, running without their leashes on the fenced off areas and the playgrounds, even on the oval,
ReplyDeletedogs attacking other dogs and most recently two women walking towards the oval (why haven't we heard about this?),tenants at each others throats over the disgusting habits of their dogs, including shi...ng., all over the grounds and not picking up after them, and attracting this type of tenant who thinks they're so special and nothing applies to them. It goes on and on.
Thank you TS for starting the ball rolling on decimating this community.
And for all others who carried on the continual destruction until it really is only a place for transients, students, AirB&B'ers.
The stress and lack of sleep impacts too greatly. Time to leave before they carry you out in a box. BTW: will Blackstone pay for the funeral?
