Our landlord, BLACKSTONE, can't handle Stuy Town and Peter Cooper Village. There is a lack of enforcement of certain "rules," and no amount of notice to this alleviates the problems. We are continually being told half-truths and fabrications. And we have no viable Tenants organization, despite our TA asking for dues all the time. So far, the politicians have proven to be basically useless. A typical New York story.

On earlier comments, yes you can challenge your rent going back more than 4 years and should especially here with the transient population who is not setting roots so they do not challenge the rent increase calculations deregulating the apartments. As of Bloomberg, zoning laws mean nothing. Every now and then a monstrosity shoots up twice as tall as surrounding buildings. It's all about the money.
I just found out from people who moved in 2 years ago when they signed up, CR never explained to them difference between market rate rents and legal rents. This is really quite deceptive. I know their unit has been turned over at least twice. Have no idea of the churn before I moved in 20 years ago. Anyone like these folks really needs to find out if they're at risk. The people I spoke to had no idea whatsoever what the terms legal and market rate rents refer to.
I think our so-called DOB and the "architects" it approves are just begging for another terror attack. These ugly and weird-looking buildings are such eye-sores and almost have a bull's eye on them.

The terms to know are "preferential rent" and "legal rent." A preferential rent is lower than the legal rent, but the lease should say what both amounts are. Many newer tenants are paying preferential rents, which are most likely good only for the term of the lease. When their leases come up for renewal, the RGB increase and any MCIs are added on to the legal rent. Management can choose to set the rent at any amount up to the full legal rent, which can be hundreds of dollars higher than the preferential rent. Many newer tenants aren't familiar with the terms of their leases or the ins and outs of the situation, so they're taken by surprise when management jacks up the rent on renewal. In recent years, lots of landlords offered deals, e.g., 13 months for the price of 12, free amenities. But there's no guarantee that you'll get the same deal on renewal.

To the guy who asked about our matter. Here is information for you to follow if you are really a market rate tenants looking to get some of your money back and not a troll.
"The Rent Code Amendments of 2014 (RCA 2014), require an owner to provide the first tenant of an apartment deregulated pursuant to High-Rent Vacancy with a notice (HRVD-N) created by DHCR, that details the last legal regulated rent,
the reason for deregulation
and calculations of the rent qualifying for deregulation.
The notice must also contain a statement that the last legal regulated rent or maximum rent may be verified by contacting DHCR.
The notice must be sent by certified mail within 30 days after the tenancy commences or after the signing of the lease by both parties, whichever occurs first, or shall be delivered to the tenant at the signing of the lease. In addition, the owner is required to file a registration statment for the subject apartment with DHCR. The registration must indicate that the apartment is deregulated and the last legal regulated rent.
It must be served on the first tenant of an apartment deregulated pursuant to High-Rent Vacancy within 30 days after the tenancy commences or the filing of such registration, whichever occurs later.
They do make it very complicated for tenants and very easy for landlords. Landlords also have organizations teaching them how to do all of this like REBNY, RSA, and so on.
The TA is supposed to be doing the same for tenants but the PCV ST TA is acting more like a 411 operator giving you links that you could find on your own. they are trying to slow down tenants so I would just bypass the TA and do it for yourself. Its not all that hard. We can't do it for you. You have to do it for yourself.
There are plenty of mechanisms in place what would allow us to fight MCIs and illegal/questionable renovations.
Here's how it's supposed to work. Any responsible TA would organize a massive effort to submit complaints against MCIs and questionable renovations. Inevitably there would bureaucratic inertia that needs to be overcome. Every filer who does not receive a response or does not get action against a case number would inform their councilman and for each of these, the councilman would issue an inquiry and brings heat on any bureaucrat who doesn't respond.
So why isn't this happening here?
You know part of our political influence here used to be the old Jefferson Democratic Club. With that club gone our influence is diminished. I will look into joining the Grammery-Stuyvesant Independent Democrats.

Obviously the Garodnick-TA trolls and their P.R. lobbyists are still afraid of Guterman.
They should be much more afraid CWC will propose an affordable coop conversion offering tenants a real choice: Purchasing our homes at a price level most of us can actually afford or renting because it makes economic sense and we choose to, not because we prefer ownership, but can't afford an expensive Brookfield condo.
What is clear is politicians are using their office for real estate deals instead of serving the people even "working tirelessly" on the purchase by evicting people from their homes with illegal overcharges.

According to the Garodnick update at the last TA meeting, CW has up to 3 more years to sell with the possibility of a 3 year extension. And that's for a sale...which may or may not lead to a conversion. So 'a conversion looming?' I don't think so.
First. It's been the cause around here since the first MCI was issued in 1984 for a boiler room paint job at $2+ per room. I filed a PAR for that and every single MCI our building has ever gotten and have literally gone door to door trying to get my neighbors to do the same. Most people are too afraid or busy to bother.
Second. I don't recall all the details, but way back when, the TA had the definitive goods on an MCI that involved some kind of landlord collusion with RCN. It may have been for the re-wiring or the windows. Anyway, MCI construction work is supposed to be by the book or they are thrown out. I said "supposed to be." because despite all the evidence about landlord/RCN impropriety, it was approved by the DHCR and it was upheld in court (courts being loathe to go against a state agency).
State MCI law overwhelmingly favors the landlord and it doesn't help that the DHCR was built during the Pataki Administration either. A lot of those Pataki era employees are probably still around and after listening to the TA attorney at the last two meetings, it shows.
BTW, you might want to look into he Samuel J. Tilden Democratic Club, which is the local Democratic Club for our Assembly District, the 74th. It's named after Samuel J. Tilden, the NYC lawyer famous for being a political reformer. It meets at the Seafarers International House on 15th St near Union Square. You'll see a lot of STPCVers there. You may also want to check out TenantsPac. You'll see a lot of ST-PCVers there too.

Agree with 3:24. Every time a TA supporter comes here, there's no pretense or subtlety. Pretty easy to spot. If just once one of these guys dealt with specifics, they'd have some credibility...but the second you ask them to defend the condo over co-op decision in any detail, they're gone.

The "Peter Cooper Village Stuyvesant Town Tenant Association" is credited with the biggest OWNERS TO REPLACE TENANTS anti-tenant Movement.
The "Affordable Housing" program is the creator of a Tale of Two Cities with 80% housing for the wealthy and 20% for the poor with zero Middle Class housing.
And rightfully as a commentator earlier mentioned, that is a NYC with 80% of housing for 1% of the population.
Last but not least
"Tenant bid" is really a Brookfield bid.
All this "inside baseball" conspiracy theorizing is senseless. What is clear is that a sale is looming and a conversion of some sort is inevitable. Hiding your head in the sand and not engaging for the best possible outcome is stupid.

ReplyDelete"The Rent Code Amendments of 2014 (RCA 2014), require an owner to provide the first tenant of an apartment deregulated pursuant to High-Rent Vacancy with
a notice (HRVD-N) created by DHCR, that details
the last legal regulated rent,
the reason for deregulation
and calculations of the rent qualifying for deregulation.
The notice must also contain a statement that the last legal regulated rent or maximum rent may be verified by contacting DHCR.
The notice must be sent by certified mail within 30 days after the tenancy commences or after the signing of the lease by both parties, whichever occurs first, or shall be delivered to the tenant at the signing of the lease.
In addition, the owner is required to file a registration statment for the subject apartment with DHCR. The registration must indicate that the apartment is deregulated and the last legal regulated rent.
It must be served on the first tenant of an apartment deregulated pursuant to High-Rent Vacancy within 30 days after the tenancy commences or the filing of such registration, whichever occurs later.

They do make it very complicated for tenants and very easy for landlords. Landlords also have organizations teaching them how to do all of this like REBNY, RSA, and so on.
The TA is supposed to be doing the same for tenants but the PCV ST TA is acting more like a 411 operator giving you links that you could find on your own. they are trying to slow down tenants so I would just bypass the TA and do it for yourself. Its not all that hard. We can't do it for you. You have to do it for yourself.

ReplyDeleteThere are plenty of mechanisms in place what would allow us to fight MCIs and illegal/questionable renovations.
Here's how it's supposed to work. Any responsible TA would organize a massive effort to submit complaints against MCIs and questionable renovations. Inevitably there would bureaucratic inertia that needs to be overcome. Every filer who does not receive a response or does not get action against a case number would inform their councilman and for each of these, the councilman would issue an inquiry and brings heat on any bureaucrat who doesn't respond.
So why isn't this happening here?
You know part of our political influence here used to be the old Jefferson Democratic Club. With that club gone our influence is diminished. I will look into joining the Grammery-Stuyvesant Independent Democrats.
That's what the Oval will look like in 20 years.

Obviously the Garodnick-TA trolls and their P.R. lobbyists are still afraid of Guterman.
They should be much more afraid CWC will propose an affordable coop conversion offering tenants a real choice: Purchasing our homes at a price level most of us can actually afford or renting because it makes economic sense and we choose to, not because we prefer ownership, but can't afford an expensive Brookfield condo.
What is clear is politicians are using their office for real estate deals instead of serving the people even "working tirelessly" on the purchase by evicting people from their homes with illegal overcharges.

The New York City Council needs to clean house with indictments and prison sentences just as much as Albany.

ReplyDeleteAccording to the Garodnick update at the last TA meeting, CW has up to 3 more years to sell with the possibility of a 3 year extension. And that's for a sale...which may or may not lead to a conversion. So 'a conversion looming?' I don't think so.

ReplyDeleteFirst. It's been the cause around here since the first MCI was issued in 1984 for a boiler room paint job at $2+ per room. I filed a PAR for that and every single MCI our building has ever gotten and have literally gone door to door trying to get my neighbors to do the same. Most people are too afraid or busy to bother.
Second. I don't recall all the details, but way back when, the TA had the definitive goods on an MCI that involved some kind of landlord collusion with RCN. It may have been for the re-wiring or the windows. Anyway, MCI construction work is supposed to be by the book or they are thrown out. I said "supposed to be." because despite all the evidence about landlord/RCN impropriety, it was approved by the DHCR and it was upheld in court (courts being loathe to go against a state agency).
State MCI law overwhelmingly favors the landlord and it doesn't help that the DHCR was built during the Pataki Administration either. A lot of those Pataki era employees are probably still around and after listening to the TA attorney at the last two meetings, it shows.
BTW, you might want to look into he Samuel J. Tilden Democratic Club, which is the local Democratic Club for our Assembly District, the 74th. It's named after Samuel J. Tilden, the NYC lawyer famous for being a political reformer. It meets at the Seafarers International House on 15th St near Union Square. You'll see a lot of STPCVers there. You may also want to check out TenantsPac. You'll see a lot of ST-PCVers there too.

Maybe there will be a sale. Maybe not - maybe just a handoff to parent company Fortress. I don't know about you but I am sick of paying Market Rate with all its illogical calculations to hold out for what? A $4.7 Billion price tag! That is not what we signed up for. I was and still am tenant bid - the best tenant bid. Form all we have seen that is the Guterman co-op bid. Nothing else stabilizes the community. I hate that term anyway "New Stabilizers". It makes no sense, we stabilize nothing. We are pawns financing their deal and ending up on the short end of the stick.

What?! That is one seriously odd comment and I'm finding it odd that it's gone completely un-commented on. CWC is gonna offer us shit. If they keep their greasy, grubby hands on STPCV our choices will be to stay in an overpriced under-managed rental dorm or move. And nobody is afraid of Mr Guterman after tenants almost unanimously ignored his proposal. Seroiusly. At the risk of getting flamed a la 2:02 pm -- who's posting stuff like this?
Agree with 3:24. Every time a TA supporter comes here, there's no pretense or subtlety. Pretty easy to spot. If just once one of these guys dealt with specifics, they'd have some credibility...but the second you ask them to defend the condo over co-op decision in any detail, they're gone.

I'm one of those people who have been here for over 25 years and intend to stay around as a renter whatever happens because I can't afford to buy and it wouldn't make sense to take out a mortgage at this point in my life anyway.
