Please, Sir, Can I Have Some More Whipping?

Dear Residents, please enjoy!

(I didn't know that Saturday would also be the day that the Department of Health and Mental Hygiene would shut Five Stuy Cafe for infractions. So this blog posting is very appropriate as it marks one of the first times that the city has decided to close a commercial property in Stuyvesant Town. In, like in "inside," and unless I'm mistaken there was no sign which told that the drinks and food were for "residents and their guests." Much like the adjacent Green Market. This sign is something mandated by the DoB and our good councilman Dan Garodnick. It was not shown anywhere as far as I know. No matter, the closure by the Dept. of Health and Mental Hygiene was not because of the lack of this sign. As soon as the city tells us, we will inform residents why the place was closed, which had to be closed for a number of violations. This blog posting will address this issue specifically.)

Update, 11/28/16..Why it was closed (not counting the above, which is against the law): 

Violations recorded in the following area (s), a Notice of Violation issued and establishment ordered closed by the Department of Health at the initial operational cycle inspection conducted on 11/26/2016.

"Critical" violations are displayed in red.

Violation points: 50

Sanitary Violations

1) Hot food item not held at or above 140º F.
2) Cold food item held above 41º F (smoked fish and reduced oxygen packaged foods above 38 ºF) except during necessary preparation.
3) Food from unapproved or unknown source or home canned. Reduced oxygen packaged (ROP) fish not frozen before processing; or ROP foods prepared on premises transported to another site.
4) Food Protection Certificate not held by supervisor of food operations.
5) Personal cleanliness inadequate. Outer garment soiled with possible contaminant. Effective hair restraint not worn in an area where food is prepared.
6) Food not protected from potential source of contamination during storage, preparation, transportation, display or service.

7) Non-food contact surface improperly constructed. Unacceptable material used. Non-food contact surface or equipment improperly maintained and/or not properly sealed, raised, spaced or movable to allow accessibility for cleaning on all sides, above and underneath the unit.
8) Proper sanitization not provided for utensil ware washing operation.

Let's revisist Rick Hayduk's message to tenants:

Dear Residents of PCVST,

This afternoon at approximately 4:15pm the Department of Health and Mental Hygiene closed Five Stuy Café for infractions that were predominantly administrative in nature.

StuyTown Property Services is working closely with the third party operator of the café to resolve the infractions and subsequently schedule the necessary return visit by the inspector.

The infractions and a description of the infractions will be made public on the City’s website at www1.nyc.gov. Once posted, you’ll note most were administrative; there were also general food infractions that were immediately resolved.

The operators of Five Stuy are greatly disappointed, especially after receiving an “A” rating from their last inspection. They are committed to resolving the outstanding issues while implementing procedures such that the infractions are never revisited.

StuyTown Property Services shares their disappointment but remains confident in their ability to serve the residents of PCVST safe and delicious food, as they have since opening this past summer.

This is the "A" grade given to Five Stuy Cafe on 7/28/16, "current" violations in red. Notice that this one critical violation is back again at number 6 in the new rating, of which only two restaurants in this zip code have been closed, the other being "The Vacancy Project":

1) Food not protected from potential source of contamination during storage, preparation, transportation, display or service.
2) Plumbing not properly installed or maintained; anti-siphonage or backflow prevention device not provided where required; equipment or floor not properly drained; sewage disposal system in disrepair or not functioning properly.

Update 11/30/16: Since it has been raining yesterday and lousy today, chances are I won't be able to present more photos of the Five Stuy Cafe. The torn notice from the city is still there, of course. 

I should say that Monday I took some more photos, some of which didn't come out as I wanted and one of which I didn't really want to show. It was a splayed out and very dead black squirrel not far from Oval Study. It was lying near the pedestrian walkway, but thankfully picked up before I got back. (Today, a Zamboni is going around and around the walkway smelling up the place, while it tries to gather all the fallen leaves.) Starting yesterday, from what I see, there are some people (one, two?) in the cafe trying to fix the place for the new inspection. The many spots outside where dogs piss are not part of the violations. I took photos of the darkened areas, though. How you can eat or drink, while a dog pisses nearby...well, it's up to you. Bon appetit!

Update 11/30/16:

Gone! The notice of closure of Five Stuy Cafe has been torn some more and wiped clean. It was there (the torn one) in the morning hours, but pre-lunch it has been completely erased/deep-sixed. There is an explanation which is not suspect. Let me repeat in case this is a "trap"--there is an explanation which is not suspect. But if you go to Five Stuy Cafe, you will find no sign.

I've taken photos, btw, but I must leave for a while.

Dear Residents of PCVST,

As stated in my note this past Saturday, Five Stuy Café, located on the Oval, was regrettably required to cease operation by the City’s Department of Health and Mental Hygiene (DHMH) after a routine inspection. The operator of the Café has been working diligently to rectify the violations in cooperation with the DHMH and was re-inspected today.

As such, StuyTown Property Services (SPS) is pleased to inform residents that the DHMH has authorized the re-opening of the Café tomorrow, Thursday, December 1st, at 6am.

SPS can assure residents, consistent with the DHMH’s re-inspection, that there are no further concerns with food preparation or food transportation processes. In accordance with standard DHMH protocol, the Café will have a “Pending” grade until a follow-up inspection is performed. At the conclusion of that inspection, the DHMH will re-issue a letter grade. Five Stuy Café’s operator has taken responsibility for the deficiencies, quickly corrected them, and asks the valued residents of PCVST to return to the Café to experience what has made them so successful since opening this summer. As a further expression of the operator’s sincere desire to welcome you back, enjoy a free Dough doughnut with the purchase of any item tomorrow (Thursday, December 1st) from 7 – 10am and 6 – 8pm.

Right now the cafe has a "Grade Pending" rating. Once the new rating by the city will be given, it should appear in front of the window.

I asked whether the Tripp and Cooper restaurant, in Brooklyn, is owned by the same LLC--Cooper Cafe--as is Five Stuy Cafe. Interestingly, all the available references of Five Stuy Cafe are in the name of Stuyvesant Town, so this is a more difficult nut to crack. It appears that Tripp and Cooper is owned by the same people, though the specialty at Tripp and Cooper is crepes. The food/drink signs are similar and it is near Brooklyn Tech, so it has a college clientele. I am not, however, assuming that it is the same. If it is the same, the grading history is of interest. A summary is here. While currently the grade is A, it wasn't that way in the past. It doesn't surprise one that some constant problems exist: their Food Protection Certificate is frequently unavailable and the current letter grade is not posted all the time. The current letter grade is not "critical," so the establishment can piss off this requirement and still get an A grade. Again, I am not certain that the two establishments are owned by the same people, but I have my suspicions. 

Also it should be noted that initially the "ungraded" grade of Five Stuy Cafe was B. This is never mentioned by anyone. All one hears about is A.

Incidentally this is the news item on this closure by TOWN & VILLAGE.  Note the doggie urine stains on the side low wall.

Well, tomorrow, December 1st, Five Stuy Cafe opens again. Good luck!

    "DHCR has published the new A/C charges that went into effect on October 1. Because electrical costs went down this year (as did other costs, hence the rent freeze), the A/C charge has gone down. It will now be $26.65 per month per air conditioner. The decision came too late to be included in the October rent bills, so we should see a credit on our November bills."

We pay HIGH rent to live in LIVABLE APARTMENTS!!! This is NYC so we can get coffee, snacks, breakfast and many more things OFF the property (and not very far away) and don't need management's inferior, lame attempts to provide us with "amenities." Godammit, Assholes, you can't even organize the recycling rooms so they work and you are trying to branch out into other things. Stick to what you are supposed to do and work on doing it better than you have been doing. We will get our coffee off the fucking campus!

  13. I was grossed out in the summer when I saw that the pastries did not have a cover and flies could easily get on them and, worse still, people could breath on them!

    If they channeled their efforts into making this a quiet, clean and respectable residential complex and less of a dorm with stupid sideshows, we would all be better off.

  15. I agree 100% with the above posters that these so-called amenities are a bunch of crap. The reason why they have these "amenities" is to attempt to justify the high rentals here. In truth there are no real amenities like doormen and swimming pools, so they have to advertise this crap such as a café, concerts, and movies. The QOL here is disgusting, it is a real student/hotel dump. Every day I see more and more transients moving in and out. The so-called amenities are Blackstone's attempt to cover up their crimes.

  16. From personal experience: Barking dogs at the cafe. There was at least one dog ("aw, isn't he cute?") that barked continually and loudly at other dogs, either dogs at the cafe or being walked around the Oval. Dogs were allowed to prance on the tables, too. Now this must be a violation! And it is not just newcomers with these dogs. I would see elderly ladies sitting with their Fidos at the Oval cafe tables. Blackstone was careless, and because of the dollar sign let these residents do whatever they wanted with their four legged friends. (Again: "Aw, aren't they cute?")

    The place, when I took a look in the late afternoon, was filthy. No excuse.

    Because of the dollar sign, Blackstone let this complex disentegrate. Fuck the signs; we have more than enough, and the "good neighbor" policy is not working. I see infractions of "the rules" every time I go out. Let me repeat that: every time I go out. It could be clumps of dog shit, dogs that are more than 50 pounds, bikes being ridden around the Oval, speeding skateboards, smelly and wasteful zambonis, PS officers who look the other way on purpose, laundry carts that are being used outside of the laundry room, filthy recyclable areas, barking dogs in apartments, pounding hockey pucks, etc, it is all here and more. Blackstone wake up! This is an opportunity to start enforcing "the rules," instead of looking the other way and hoping residents get "it" or help enforcement. Unfortunely I know which way you will choose to go. The easist way, which will be to BS residents and continue on. There may be a week or two of tightening "the belt," but otherwise it is expected that everything will continue. Surprise me. That would be something!

  17. The new grade is not up yet. It should be tomorrow or the day after. The site shows the earlier grade, 9 (A), which was reduced from 19, as an attempt is made to have the restaurant fix the problems first. If this wasn't the case, and 19 was the score of the first "official" inspection, the grade would have been B.

  20. The ungraded inspection of Stuy Five Cafe was on 6/30/16. 19 points were given and a time period in which the cafe could improve. The final grade was A, 9 points, of which the following was in red, a "critical violation:"

    "Food not protected from potential source of contamination during storage, preparation, transportation, display or service."

    Can let? What I've seen is dogs doing "their thing" regardless of the greenmarket. Some owners do not care. So greenmarket or not, the dog will do what he or she has to do. Aw, isn't he/she cute!

Also bought a sandwich which was so-s0. We do not need a café in here, another place to attract food and vermin.

    Seriously, as a Real Rent Stabilized tenant, I have never, and will never, give a dime of my business to any of the so-called "amenities". I even avoid shopping or dining at any of PCVST's commercial tenants. Why give them your hard earned dollars only to see some of it flipped back to the landlord, who wants nothing more than your quickest vacancy?

  28. @Atomic Man .. Associated is the only store that I will patronize that is a tenant of our stinky landlord. Associated is, imo, an asset to the community, especially the seniors and disabled who live in Stuyvesant Town. It's probably too far a schlep for tenants who live in PCV. I know it is not the easiest of stores to shop in because it is so small and cluttered, but the prices are great and the people who work there are very, very nice. I would never, ever, even if I was starving and no place else was open, spend a dime in Five Turd Cafe. Just the sight of all the dog shit around the place would make me gag on my food.

  33. Someone must have gotten sick from the food for the city to give Blackstone any kind of grief on anything Blackstone Ivanhoe Cambridge do to tenants. Only a looming lawsuit from injury or sickness could get the city to enforce anything in PCVST. Once the "third party" remedies the city violations then the city can say they are not liable for a lawsuit and Blackstone Ivanhoe Cambridge will minimize their risk. This stinks of a cover your ass risk management maneuver by the city and by their Ivanhoe Cambridge Blackstone pals.

    Actually, it is very easy to get an "A" rating when you open up, as you are given a chance to redeem your store after the initial review, which is not official. Five Stuy Cafe received an initial "B", but they were able to up it to an "A" once they improved. There was one "critical" note, which returned again this time! So the cafe wasn't listening. I will talk about this some more in a further posting.

He knows that it would reflect badly upon him and his ability to run this property in a competent fashion. This is how I know this report is without merit.

  55. There is an "issue" regarding the grading and its wording. My way is fairly easy: 1) Put into Google: Restaurant Grades - NYC.gov 2) Then just put in the info: Name: FiveStuy Cafe, zip code: 10009. The website lists the first two as one word, btw, but it shouldn't matter. The last page will be the closed restaurants in this zip code. There may be an easier way, but that is the way I do it. If you just click on the link that Rick Hayduk's email sent you, it will take more time and be a bit confusing. As to Rick's message: He has had the same amount of time to read the report as everyone else. So.the info that he is unaware, well...by now, he shouldn't be. He can always amend his letter to tenants.

    As I said in a previous message, Blackstone is pissed at this closure and, from what I gather, pissed at Five Stuy Cafe. Whether they are also pissed at the various sites (including this one) is another matter. They should be pissed at themselves too, for not being on top of the situation, even before the closure. My prediction, however, is that Blackstone will not change.

    I dare say that if 'closings' required Board approval, the cafe would still be open. Blackstone holds a lot of sway here.

    Apparently, inspectors have a great deal of independence and (if they chose to) probably could raise quite a stink with the media if the Board tried to influence.

    They particularly recommended the coffee, pastries and the signature sandwiches.
    They raved about the bonus received after a few hours: back in Brooklyn we called it the Hershey Squirts.

All are welcome, residents and non-residents, no Stuy Town IDs are required or asked for, no signs (see ice rink) are posted accordingly. They even deliver to ANYONE. This café is located in the NYC zoned classified R7-2 (residential use only) designation of the interior of Stuy Town.

  88. Don't the leases stipulate that all 'walking areas' of an apartment are supposed to be covered by rugs or carpets?

    It seems to me that the landlord (Blackstone) has to apply this standard uniformly to all apartments. I would think they could open themselves up to a class-action lawsuit by tenants who feel the landlord is not complying with it's own lease regulations.

    I will contact a few attorneys regarding this issue. If any attorneys are reading this blog perhaps you can comment as well.

  89. Blackstone has, they say, a long-term commitment to this place. Unless part of the plain is to gradually tear it down and build super deluxe high-rises, I don't see how they can fix it. BTW, don't think that residents would over-squawk at the demolition of this place. While the old-timers may do squawk, the old-timers are getting less and less, and super deluxe high-rises, if done appropriately, can be made appealing. We, of course, would get no rest, but since this property has been sold for over 5 billion, when have we gotten real rest?

He worked hard for the tenants when he was leading the TA and there is only so much a person can do, especially when the property is in the hands of robber barons who are in cahoots with sleazy politicians. The fact that he is still volunteering for TenantPac and an organization that seeks to keep seniors in their homes shows that he is a man of good intentions who cares about people. Let's think of the good things he has done, rather than what good he didn't manage to achieve. I certainly don't believe he did us any harm.

  122. A few days before the closure I observed one of the workers (not the kids who work there) in the meat area handling meat without gloves. I was going to say something but didn't A couple of days later there he was again with only one glove on. I mentioned to the kid serving my coffee that he should say something to this guy about wearing gloves. He looked over but of course he wasn't going to go to a?? boss and tell him to put on gloves.

    then the café was closed and this is one of the reasons, but when I asked one of the supervisors she told me the reason (singular) was that he wasn't wearing gloves.

    And this guy is still working there!. What does it take to lose your job? If he didn't bother to put on gloves I doubt if he'd bother to wash his hands after using the bathroom. Stay far, far away from the prepared foods, especially the meat area.

    How about downstairs neighbors who smoke pot that comes up into my apartment and constantly slam doors within the apartment. Maddening. Have spoken to this girl a couple of times about both issues but the potheads seem to have sawdust in between their ears cannot understand the problem. Awakened last night around 2Am by this noisy pothead, called Security but don't know the outcome. As a last resort, you have to go to the 13th Pct. and report drugs in an apartment.
    BTW: One reason Security doesn't want to get involved in the pot smokers is that Management could probably be held liable if the complaining tenant winds up in the hospital with respiratory issues and sues. Without verification the complaining tenant has nothing to stand on.

  126. It seems that as long as a duplicate top lock key is handed to management upon request, the use of the top lock is legal. But this is a legal opinion that is not the city's. The latest letter from management (Richard Hayduk CEO/General Manager) is confusing, as it arrives well after many duplicate keys have been surrendered. Then we have this: "Top Locks are not permitted..." Are they "permitted" or not? Not by the lease, if they are installed after the April 2016 date, but is management in the right?

    Then, we have numerous violations by management itself, if we read the "Resident Help" on Stuy Town own website. As an example:

    "Pathways and walkways are designed for safe passage of pedestrians. Bicycle riding, rollerblading, skate boarding, Segway transport, hover-boards, roller-skating, in-line skating or any such similar activity is permitted on pathways and walkways only if this activity doesn’t endanger or threaten pedestrians. Those engaged in said activity must traverse the pathways and walkways at low speeds. Bicycle riding is prohibited in all areas designated by signs posted by Landlord."

    Is this rule adhered to???

    Or this:

    "e. Laundry carts are provided in the laundry rooms. These carts are to be used only in the laundry rooms and Tenant is prohibited from removing the laundry carts from the laundry rooms."

    Management has indicated that they will simply replace the carts that are missing, no penalty involved.

    Or this:

    "A summary of guidelines is below although the Pet Rider contains all rules and regulations for dog ownership at PCVST.
    a. All dogs shall be registered with the Landlord.
    b. All dogs shall be leashed at all times unless permitted by Landlord (such as during an event allowing pets to run free in a contained environment).
    c. The registration tag must be visibly hung from the lanyard as attached to the leash handle.
    d. Tenants are strongly encouraged to have their dogs defecate only in designated dog areas and are required to pick-up, and clean any residual left by their dogs.
    e. Tenants are not to allow their dogs to urinate or defecate on or in any Building.
    f. Tenants are to honor the “No Dog” fenced areas; consult stuytown.com or property signage for designated dog areas, which are subject to change.
    g. Tenants with pets who incessantly make noise are subject to the disciplinary terms found under Section 2 (Quiet Enjoyment).
    h. Aggressive breeds and dogs with a combined weight of over 50 pounds per apartment will not be allowed to register. All registered pets are subject to New York statutes and rules regarding multi-family dwelling dog ownership."

    The persistence of management to ignore some of these rules can be infuriating.

    I am glad management wants to discipline tenants, but management is selecting, rather than enforcing. They know this, too.

Of course they are not going to crack down on the noisy student demographic, the dog shit offenders, the speeding bicycles and any other rules that the enforcement thereof will upset the demo they want. The older folk in the real RS, unrenovated apartments had better be on their guard not to put a doormat outside their door, to make sure the Stasi has a copy of their top lock key and had better be on their guard at all times because Management wants these tenants to give them a reason, any reason, to kick them out.     These transients (temporary NYC shelter, short term corporate housing, extended stay hotel guests, students and post grads packed into chopped up dorms, etc.) comprise a substantial percentage of Blackstone's most profitable leaseholders. Since they may be legally prohibited from installing individual security locks, Blackstone is probably posting "rules" and incorporating restrictive language into leases hoping our decreasing percentage of legitimate "residents" living in "residential" dwellings utilized as a primary "residence" are ignorant about their legal right to install individual safety locks as a routine personal security measure and hence, fail to exercise their right to protect themselves, their families and their property inside their homes.

    The massive amount of transients churning through apartments since Speyer are directly and indirectly causing crime to spike in what was once the safest community in NYC to settle down, plant roots, raise a family and enjoy a comfortable retirement. Now If anything, following a standard residential security precaution practiced by our neighbors in Alphabet City we should all be considering installation of multiple safety locks on our individual apartment doors.

    This special place did not have to end like this. De Blasio, Garodnick and the TA Board needlessly killed Stuyvesant Town.

  133. The way I read it, residents of PCVST have a right to install top locks but give a duplicate key if it is requested, which it has been. No threats, please, or pounding at the door. For Blackstone management this is something that has to go back to the lawyer or lawyers, and changed or worded better.

    this is the new normal. It's NOT going to change. Either take steps to alleviate your problem or think about moving, because you're going to have problems with whoever is above you if they don't follow the rules here and don't really care.

    It's quality of life before a cheaper ret.

Seen: Two, yes two, bicycles being ridden around the inside of the Oval path; numerous other violations, including no presence of our PS security outside. I predicted this "no change" would happen, and it has. These guys just don't care.

  143. 2:55 - They will move out well before I do. I've lived here long enough (30+ years) to know it's only a temporary arrangement when people of a certain age room together. If past experience is any indication, they will be gone by spring. At least the previous 4 different sets of tenants were nice and made an effort when I asked them to be considerate. Not these creeps; they are entitled!

  145. Over at the non-official FACEBOOK for residents, I just learned that Neptune, the restaurant nearby on 1st Avenue, is closing. They (the folks who have the money and the connections) are killing us. Slowly, surely, the city is dying. But the high prices will be there. I see the young people taking out mom and dad's credit card to buy produce at Gracefully. BTW, wasn't Garodnick not willing to support small business?

  146. I have no intention of recycling or composting until Management starts to actually manage and does something about the terrible conditions here. The recycling rooms are verminous, the grounds are unsafe because of bicycle and vehicular traffic and the indoors from the partying hipster/student/transient demo is at a level that causes illness from lack of sleep and frayed nerves. This place has become a filthy, dangerous, nasty hellhole and if that's the hallmark of Blackstone, then they should get out of the property business immediately and try their hand at something they are competent to do and do well.

    Damn right! So sick of these fucking jerks ruining the lives of everybody who needs their sleep and the quiet enjoyment of their apartments. We all pay rent, but Blackstone acts like it is only the party animals who do. Maybe some of them pay a lot of rent to live in their crowded spaces, but they do a lot of damage and strain the infrastructure much more than their normal tenant neighbors, who also pay rent!

  151. Blackstone has been in charge here for about a year and the demographic has worsened. The TA needs to press them on their promises that this would be a family community. Of course they will not do that, as they are useless. I don't see any hope in turning this community around. As older residents pass away or move, there will be an ever increasing number of dorm, transient, and organization apartments. Real garbage is moving in here. I've got it next door in the form of some kind of ministry. I hate to sound pessimistic, but with a useless tenants association, there is not much we can do but move.

  152. 8:20 pm I think this is a deliberate strategy by Blackstone to make people move. They put in the neighbors from hell to live next door to them to harass them into moving out. I am going nowhere because I am not in a position to do so. Would that I could. But if they put shit next door to me, I will fight them tooth and nail. I have friends in the newspaper reporting business and I will call on them, if necessary, to document any harassment these bastards may send in my direction.
