The Management Office Controversy



Work has begun on the complex's new management office, which is going to be an extension of the space that is/was used by Oval Concierge. The latter will now be housed across the 1st Street Loop.

Unfortunately, my time to look into this is extremely limited at this point, but I do want to post information that the project has generated some controversy.  A few tenants are monitoring work permits and the Department of Buildings responses to the plans for this construction.  Seems the DOB did not acquiesce to the plans on 12/23/2013, but then changed its position on most of the applications on 12/27/2013. Also, recently, a stop work order was issued by the DOB when no permits were available and yet work was proceeding. (The permits are up and on display now.)

The overriding issue is whether this construction is one more instance of the removal of tenant use of property in favor of management space and commercial space. Certainly, we are currently seeing various areas of the complex being transformed for such usage. And nothing is stopping CWCapital from crafting commercial usage out of pockets of PCVST, as long as the commercial entities are, wink-wink, "for residents and their guests."

Interesting, too, that management is building a new office near 1st Ave as a protection against another Hurricane Sandy, but will be selling the previous space along the FDR drive for a commercial entity that will have something do with children. So one assumes that it's okay for a children's area and the garages along that street to be at the potential mercy of a hurricane, but not the management or security office. Just as a thought: I wonder if something far less expensive could be crafted to protect that side of Stuy Town (and Peter Cooper Village) in the event of another similar, and rare, hurricane. Was this ever looked into? And what will the protection be for the east side of PCVST if another devastating hurricane does come?

... And is the construction of this new management office another MCI waiting to happen?

I think your catastrophizing a bit. If they put some sort of children's service on Ave C, seems like they'd have time to close in case of dramatic weather predictions. We are not yet subject to unpredicted flash flooding.
As a long-time tenant,rent stabilized, I find you tend toward the overly negative and are a bit curmudgeonly. I do appreciate your efforts though.

Dan was told of tenant opposition to the construction last Spring 2013. He did NOTHING.

Dan was told its wrong to spend $5+million on these offices while he is telling the press tenants will soon be hit with mci for plumbing upgrades on our old pipes.
He didn't care.

The buildings have weak foundations, weak plumbing, old electrical wiring and overstressed walls.

11,000 square feet of offices will overburden the buildings infrastructure.

This construction is unsafe to expand the cellar to build 11,000 square ft offices.

For comparison, the Oval amenities buildings are 1700 square ft. This building is 5 times the size of an Oval amenity building.

Its reckless and unsafe. If anything goes awry with the usual shoddy CW workmanship the city is at fault as much as CW and TA. Tenants have been vocal about our safety concerns to every city agency.

We also spent a little time telling the local pols and TA as a formality - not expecting them to do right - but they can't say "we didn't know". They know.

Now there is NO WAY we will buy into a Garodnick CW TA Brookstone negotiated deal.

This is the meeting we commented on earlier that the TA lied!

the TA quietly slipped notices under doors in CW style inviting tenants from 272 274 276 278 280 300 first avenue to a meeting to "discuss" the office construction and pretended to invite the local pols garodnick hoylman kavanagh (who obviously didnt show up for the fake meeting) and invited cw compass rock although cw compass rock were not guests but actually they ran the meeting!

the TA oct 7 2013 invitation was a trick to get us to attend a CW Compass Rock meeting (see article link below).

when we arrived it was clear this was a trick by the TA as they had CW Compass Rock run the meeting with the TA speaking up here and there to make sure we don't oppose the CW Compass Rock plan.

the TA lied to us.

the TA also did NOT bring the construction plans but instead gave us a lot of lip service and more lies. they had the plans but didnt want to show us them.

shady shady.

don't trust the TA!

and don't attend a TA meeting its a trick to get you to attend a CW Compass Rock meeting!

mad as heck they did that to us!

NO ONE IS PROTECTING THE TENANTS NOR THE PROPERTY.

This is criminal by the three amigo politicians who should have protected the homes of 30,000 people with a court order that money spent on the property goes to the infrastructure ONLY and not to frivolous new buildings for amenities. instead the three amigos pushed the real estate developers agenda to put a
$15+ million dollars strip mall in what was once an 80 acre park of homes to enrich the lives of the POLITICIANS!

So stupid - especially while the homes are in need of plumbing work! how greedy and stupid are these people?!
good lord - you don't build a home office when your house needs updates plumbing.

STPCV used to look like upscale tree park with homes, families, community.
now it looks like an industrial wasteland downscale low class strip mall.

what did they promise the TA - a big corner office in their $5million new office to go with their oval gym across the the ta president's home?

time for a new purchase proposal on the table because the TA CW agreement with Dan and Brookstone will bankrupt not only the property but also all those who buy into it.

the permits are not signed off yet! tenants are still fighting. and are forcing CW TA to be truthful in their permit applications as their plans don't match the permits.

CW TA tried to build offices in our residential building. we tenants fought it. Now CW TA have applied to rezone 274 from Residential to Commercial. We are pushing back.

CW TA lied to the dept of buildings claiming no change in use, exits occupancy to get their partial approval when they are changing use, exits and occupancy with the addition of office workers. so blatant their lies.

274 should not be rezoned for commercial use.

we asked Hoylman to keep his word and oppose the rezoning - still waiting on his actions to match his words keeping our building residential. will he succeed?

so permits are not signed off -
the rezoning is pending -
and the fire and sprinkler system they proposed with their lie of no change in occupancy is still DISAPPROVED by the dept of buildings.

I didn't suggest that the kids wouldn't be evacuated before a hurricane, but that the area would be flooded again. That's why my question of what CW is doing to prepare for the possibility of another hurricane along Ave C.

ave c was not properly cleaned of black mold in a responsible time frame - its UNSAFE for kids and should be inspected thoroughly behind walls under floors before we put kids in the space!

317 Ave C is not zoned for commercial use. it cannot be rented out to a third party company. CW Susan Steinberg TA need to stop their negotiating with day care companies.
its illegal use of the space.

garage 5 flooded twice and everyone lost their cars.
TA CW have not made the garage safe for our cars.
they have not put in drainage.
they have not properly cleaned it. they have not repaired the electrical wiring from the fires of the Sandy flood.
CW TA made everyone in garage 3,4 put their cars in 5 before the storm.
then didnt protect garage 5 from flooding even though it has a history of flooding.
TA CW dont care about our cars or our getting to work.
they dont care about safe locations for kids day care.
they care only about lining their pockets.
they are ugly ugly people inside and out.
GARAGE 5 SHOULD BE CLOSED - ITS A HAZARD!

but the kids day care can be washed away in the next flood - who cares. and our cars can be washed away in the next flood. TA CW dont care about that either.

the real reason - TA CW want to charge tenants 10X that for the shiny new offices in the purchase scam they are "negotiating" (colluding).

There has been no plumbing work done on apartments that has been filed with DHCR for an MCI. It's possible (and I don't know it for a fact) that when apartments are renovated, they might be doing partial riser replacements in the renovated apartments. The plumbing issue is no secret. When Harry Helmsley bought Parkchester, they had to replace all the riser plumbing because it was leaking and ceilings were collapsing. Expect the same problems in ST/PCV, which is why I think they are probably doing some incremental work with the apartment renovations. Remember that there already was an MCI for the replacement of water lines, water tanks and valves that they did before they did the repaving.

Most of this statement seems like unsubstantiated hogwash. If they're building additions to 274/76/78, they'll need to augment the plumbing and electrical where necessary. The rest of the buildings were completely rewired with the Air Conditioning upgrade. Foundations ? Seems highly unlikely there's a problem. I'd call the DOB if you see the walls cracking.

See my above comment. They need to make allowances to provide enough water and electric, and specify that in the plans.

I just don't get the point of relentlessly bashing the TA by what seems to be a single anonymous poster. If you have provable charges of malfeasance, bring them before the appropriate body. Otherwise.... get off your fat ass and DO something about what's being done here. Organize your fellow tenants. Get out in the street with a clipboard and collect support. Go to Albany. Go to the Atty. General, but for god's sake, please stop with the constant, constant bitching, moaning and complaining about all of this. We KNOW about it.. it's been going on for YEARS now, and it should be pretty obvious to everyone that just COMPLAINING won't do a damn thing to fix it !

I live in one of the buildings affected by the location of the new management office and was the guy who "quietly slipped notices under doors in CW style" in my building for the TA. It sounds like the commenter is trying to insinuate something by that. Are you?

In addition to these flyers, I got an email blast about the meeting. So did everyone else in the affected buildings who are on the TA's blast email list.

Both TA notices said the meeting was "To Discuss New Management Office In 276 First Ave and Its Potential Impact on Residents, Green Space and Playground #8." It ended on this -- "We think it advisable at this time to organize residents of the potentially affected buildings which surround the proposed site to share information."

And that is exactly what the meeting was about, sharing info. So I'm not sure why the commenter is "mad as heck they did that to us."

I actually attended the meeting, along with about 30 others, tops. No way were 100 people there. John Marsh and Susan Steinberg ran the meeting. First CW Cap reps gave a presentation. The CW Cap reps neglected to bring visuals -- the architect's plans -- but they where very clear in describing what the plans are. The above commenter charges that the TA had the plans, but "didnt want to show us them." That's a pretty nasty accusation that should be backed up.

Then Marsh and Steinberg ran the questioning session. I was one of a number of hostile questioners. The subject hit again and again was other possible locations for the new mgmt office, including Security's old location on 14th St between Aves B and C. All of the least obtrusive locations discussed were on the flood plain. I'm not happy about it at all, but see no other options other than something on or near First Ave.

As for the structure itself. CW Cap reps were hit hard and repeatedly on it, especially the roof, skylights, and ventilation system. Who know if we made an impact, but we tried.

Your post is interesting. I hadn't heard about an effort to rezone and do not recall it being mentioned at the meeting. Does the entire project hinge on this rezoning?

Regarding rezoning. A quick Google show that the City Planning Commission has the authority needed to modify zoning for a specific project. Or the owner can request a variance from the Board of Standards and Appeals. The Board of Standards and Appeals can also issue modification of certain limited zoning regulations. This sounds complicated.

I hate the idea of putting the mgmt office here, but because of the problems with the flood plain, this effort may be an uphill slog. I would like to hear more about it, though. Maybe Sabina at T&V can get on it.

the offices should set up on 14th - its flood safe,
its existing,
its financially responsible, it protects the integrity of stpcv.
and it keeps the purchase price better for tenants to buy.

i'd like to hear more on the rezoning too. has the TA said anything on the rezoning? are they rezoning all those buildings for new offices? does that mean all our buildings can be rezoned for commercial use? wasn't that the only thing that kept us safe from this very type of construction?

There's more black mold in ST than people even know. Renting the old management office out to a day care is a class action lawsuit waiting to happen. Why is Susan Steinberg negotiating deals like this in the first place? Is she a realtor and a member of the fashion police?

I can understand the frustration of those unhappy with the TA because of what they aren't doing - they aren't opposing the rezoning.
I wouldn't doubt if the above comment is true that TA wants it rezoned because they aren't fighting it.

On the other thread a tenant posted their DOB fight records status so whoever bashed tenants for being outspoken on the TA - it seems the tenants are doing more than the TA.

I'm behind the tenants! Thank you tenants for fighting to keep STPCV residential.

I'll admit it I have said the TA should step down if they are not doing the right thing by tenants. That does not mean I am going to give up my practice to take on a TA position or should have to.

Every tenant has the right to expect the TA to do a good job.

As my dad would tell me and I tell my son, the TA needs to grow a pair, keep a stiff upper lip take criticism on the chin, let it roll of your shoulder and keep up the good fight.
If the TA is feeling bashed its probably because the tenants are getting bashed and the TA is supposed to fight for the tenants. So yeah, step down if you are not up for the fight. I'm sure someone else will step up.

Everyone needs to read the press article.
The TA said they didn't care the character was becoming more commercial less residential with 100 office workers.

"And a few trees would come down" this on top of the hundred they took down already this past year. A lot of trees are coming down for Susan's TA offices. Just read the article and all will see the tenants are right in their fight to protect STPCV.

"As for residents’ concerns, Steinberg recalled that there was some mention of a lack of access due to the fact that there would be a staff of 100 people doing this work and a staff-only entrance.

“So the character of the whole area is going to change,” said Steinberg. “It will be less residential in character and more commercial.”

its completely changing. the entire block from 16th to 18th First Ave Loop will become so commercial.

they just destroyed STPCV to a point of no return.

Whoever is behind most of these posts is seriously off his or her meds.

The TA has nothing to do with this. It's all CW. But feel free to let future customers know about the situation so that no one patronizes the facility, whatever it turns out to be.

The TA doesn't have an office and has no plans to get one. These are CW's offices.

The TA does not manage the garages.

"Garodnick did leave the door open for an MCI on plumping fixes." STR: As you undoubtedly know, the state has guidelines as to what constitutes an MCI. This is not under Dan's control.

Rezoning: What are we talking about? The new flood designations?

There's a lot of irresponsible and inaccurate frothing at the mouth from one poster on this thread, who isn't entirely coherent.

I also see no evidence that the TA is working with CW to ravage this community. Does the TA have talks with CW? Absolutely. And the TA is upfront about it, and those talks have to do with things like MCIs, etc. I would hope there are talks between the two entities!

I don't see where anyone said the Tenant association gets office space - but I see how they could when if they buy Stuyvesant in a tenant bid. Wouldn't they?
Is that what they are saying? The Board would have office space when CW moves out.

They let CW build it because there is no way if put to a vote by tenant condo owners they would approve of this. Tenant owners would insist on using the 14th street old security offices. Rightly so.

This STINKS!

Totally agree STR!
Just found out that when a landlord applies for an MCI is the time to start push back.

You're not supposed to wait after its been approved by DHCR to push back as Dan and the STPCV TA do.

We need someone who will instruct and lead all tenants to individually push back on MCI at time of application so a large number of people easily have our say.

Otherwise DHCR says things like "only 2 people opposed" and we get stuck with windows that are hard to clean and don't open and close properly.

We would have opposed if we lived here then because the windows should be easier to use.

Anyone know where we can buy screens cheaper than landlord?

Please, PLEASE pick up the phone and make a few calls, STR. You can easily contact the TA to either corroborate or contradict some of the craziness on this insane thread, esp about the TA getting office space. If you have questions about rezoning maybe they can help with that, or maybe Dan can. This is important. People are sowing disinformation here and deliberately confusing your readers and it's not helping this community.

Also. I was at the meeting. According to CampusRock reps, the playground will remain exactly as is. The benches closest to it will remain. However, trees down the center of the walkway are gone, as you say. The mgmt office roof with skylights and exit will extend back from between 274/276 to where the Belgian cobblestones are now. At the time, reps were not sure of the office would extend straight back in a straight line or from a "T" where 274/276 ended. The walkway nearer to the playground will remain, while the walkway on the other side of the cobblestones, the one nearer 274/276 is obviously gone.

There are very clear protocols established by the state to push back against MCIs. They do not involve NY City Council people.

The original MCI legislation intended to offer an incentive for landlords with RS apartments to maintain things like plumbing, roofs and elevators in their buildings. That incentive was for tenants to pay for the cost of the MCI only, and maybe a little extra. The State Senate is responsible for rewriting that legislation into the big money giveaway to landlords it became, with MCI payouts becoming permanent and affixed to our rents. And so the State Senate is where the law has to be fixed, not the City Council.

It's important to hold our elected reps accountable, but when you fault Dan Garodnick for stuff like this, it just seems personal. Your dislike of him or whatever it is seems to be clouding your judgement.

I'll admit it I have said the TA should step down if they are not doing the right thing by tenants. That does not mean I am going to give up my practice to take on a TA position or should have to.

(1) "Doing the right thing by tenants" is awfully general. In general, I think they do that pretty well, but do not always agree with the TA on specifics. But you apparently think your general dissatisfaction with the TA trumps my general satisfaction and so the TA should resign. That's not how it works.

(2) You think the TA should resign. And someone else should volunteer to spend countless hours volunteering on your behalf. Typical.

Just to be perfectly clear. I live in one of the 6 buildngs directly impacted by the new office for management under construction. I am a dues paying TA member only, not elected to anything or holding any TA position of any kind.

I don't think anyone has been shown the plans, though the DOB must have them. From what I do know, the new management office is an extension from the current concierge, going back toward 1st Ave. It will take away probably less than a half of that area, leaving behind the walkway near the playground and the playground itself, which may get some kind of upgrade.

That is very, very badly paraphrased, STR. Garodnick only acknowledged that an MCI was possible, not that it was acceptable, preferable or anything else. He'd be nuts to do otherwise since MCIs are so freaking toxic in ST-PCV.

We've got enough on our plates at this point without inventing issues. At some point in the future, the pipes will have to be dealt with. BUT: We don't know who the new owner will be; we don't know if we'll be rental, condo or a combo; we don't know that the MCI law will remain as is.

When the time comes, hopefully we will have a say about what to do about the pipes and how to pay for them. And if we do, hopefully we can discuss it like grownups here without the distortion, false accusations, and general crazy that have so far characterized the management office 'discussion.'

That's not a free pass, it's a potential legal opinion. Not every legal issue is in our favor, but this one may or may not be. It's merely a possibility. It's not lying down to acknowledge the state of the law as it exists. Everything's like a defense attorney here, where no fact, no law is accepted and everything must be angrily fought to the bitter end. It is up to the law to decide if a particular plumbing improvement is just a repair or amounts to a full MCI. It's a fact-based inquiry, not a battle cry.

But to write that Dan "handed" CW a gift re: MCI for plumbing is simply absurd. First of all, you don't think CW has figured out that plumbing is a huge potential MCI? The primary reason they haven't started that work yet, IMO, is that plumbing work would be a major undertaking involving years of work and I doubt CW will own STPCV that long.Second, Dan has ZERO control over MCIs and the law relating to them. Talk to our esteemed state reps , who in the "grand " tradition of our former State Senator Tom Duane, talk a great talk about tenants' rights and NEVER get anything passed that actually benefits tenants.

On a more positive note, I live in one of the affected buildings and I'm able to sleep with my windows open for the first time in years. The area where they're building is one of the few that isn't fenced off. It has become the de facto dog toilet/dog run. Dog owners would always let their animals shit and piss there and then let them off leash to run around and play with other dogs. They can no longer do that. I just have to hope that the construction takes 7 years because that's how long it's going to take before I can make it out of this project.

I don't understand all this unnecessary hand wringing about building out a management office behind 274/76/78. The management office has been located in at least 3 different locations around Stuyvesant Town, twice in the lower levels of occupied buildings, and (if memory serves me) once in the space where Associated is currently located. When last in 281 Ave C, all those management employees worked side by side with the tenants of those Ave C buildings between 18th & 20th, and then it was located on 14th just west of Ave C, also in the lower level of buildings, so I see absolutely NO difference in locating it in the 1st Ave Loop, save for some increased golf cart traffic, which tenants should object to.

Nobody appears to have mentioned Stuy - PCV internal Steam System. This complex does not have any furnaces / boilers.
Heat and Hot Water are provided from the Con Edison Steam System. ST / PCV internal steam system has never been upgraded or for that matter had an engineering evaluation since it was built (1947).
This system is in serious need of upgrade and I can assure you....it will literally cost millions. Absent a thorough engineering evaluation of the plumbing INCLUDING THE INTERNAL STEAM SYSTEM, you would have to be nuts to consider buying.

Know what you are buying.
Make sure you'll be able to afford increased maintenance costs to keep the buildings in good repair, increased taxes, and absorb the financial obligations of those owners who default."

Re: Steam System, more disinformation. All the steam plumbing in the basements of ST was replaced when they upgraded the system with temperature sensors installed in the apartments. Con Ed has been maintaining the steam mains on 20th st and ave C pretty regularly. Much of lower Manhattan south of the E30's gets steam service from ConEd. Stop the Chicken Little'ing !

The space that Associated now occupies used to be the personal/accounting offices for Beth Israel Hospital. It was never PCVST management offices.

Which is exactly what the TA did. For those not up on this situation, back in 2009, when all the MCIs were originally filed, the TA asked tenants to file for 60-day extensions (I have my copy of the requests) and coordinated filing them with DHCR. Later, when the Roberts case got going, the MCIs were held up (I'm not sure who gets the credit for negotiating that).

DHCR has not given final approval of the MCIs yet, but in an unusual move they have allowed CW to start collecting the permanent (prospective) part of the increases but not the retroactive portion (the maximum that can be charged--permanent plus retroactive--is 6% of what the rent was in 2009 when the MCIs were filed).

If DHCR decides to approve the MCIs, we will be able to file PARs (Petition for Administrative Review). That's the process.

I'm reading nothing that suggests that the TA is in cahoots with CW. Sorry, but I think such a suggestion is absurd. It's obvious that the TA would want to facilitate meetings between CW and tenants, so that some transparency can exist. Was the meeting with ex-property manager Sean Sullivan not worth it? It revealed much to tenants, and management had to slink off with its tail between its corporate legs.

I'm still paying my dues and still supporting, overall, the TA. My only concern is that the leadership of the TA is too fixated on tenant ownership of the property and may be disregarding legal challenges on several items because it doesn't want another lengthy Roberts-like affair that would place such ownership in a time limbo.

Strength is not in the number of followers. Its in the number of great acts and victories. If you are victorious in your battles including the mci fight then your followers will happen. If you lose or don't fight at all your followers dissipate. STR's concern these leaders won't fight because its avoiding a battle like Robert's is a justified concern. This tenants Association says it can only do things if it is great in numbers does not hold true. Any 1 person can be great. Acquiescing to the battles in the hope of a surrender at the end of CW tenure to a tenant purchase is insane. I'd rather a strong Tenant's Association that is revered and feared - that fights and wins every battle or at least tries. This is why CW walks all over us and is destroying our property. The Tenants Association lets them.

4) All Caps may have expressed it crudely but CW Capital would march all the old rent-stabilized tenants to the crematorium if they could get it. And they probably would seek an MCI for the Zyklon B gas.

The TA and Dan Garodnick will never get their hands on ST. Several tenants have already filed complaints with the Attorney Generals office regarding the whole shady affair. If and when Brookfield places a bid those complaints become full fledged lawsuits holding up any chance of Brookfield getting their bid in on time. Unless the seller wants to wait years for the legal issues to drag out, which I seriously doubt.

I'm still paying my dues and still supporting, overall, the TA.

The TA and Garodnick and his lawyers have been illegally going behind tenants backs for years. Take the whole Brookfield deal as a perfect example. Did the TA consult with tenants BEFORE they made this deal on our behalf? No, they didn't. I agree with the person in T&V calling for an audit. No proof or do you just not want to see it.

If you reread my "cobblestones" comment (posted January 13, 2014 at 10:40 AM), you will see that I said nothing about cobblestones being removed. I used the cobblestones as an easy reference point, just as the CW reps at the meeting used them, and I quote: "The mgmt office roof with skylights and exit will extend back from between 274/276 to where the Belgian cobblestones are now. At the time, reps were not sure of the office would extend straight back in a straight line or form a "T" where 274/276 ended. The walkway nearer to the playground will remain, while the walkway on the other side of the cobblestones, the one nearer 274/276 is obviously gone."

If it is my post you are referencing, I'd appreciate an apology for the insults and accusations you threw at me in your post.

Regarding those Yelp reviews,for those patently ridiculous, planted positive ones, I post “Funny” since once cannot post “Not Useful”. Also, go to the second page of the recommended Yelp reviews, go to the bottom, and click on the “reviews that are not currently recommend” link for some true, horror show, one star, reviews.

Do not ever contact your noisy neighbors. Management will get very pissed off at you and they could come after you legally for harassing your neighbors. Remember, no matter what you pay, they want to churn your apartment. Your options, keep calling PS, over and over again, keep records, use the 311 web site already provided by STR. Here it is again:

There has been a post here on another tread about going to small claims court by suing the neighbor(s) for damages but I assume, as has been posted by that person, that your claim had better be well documented and especially grievous.

OMG! You saw the snakes too? I was going up the stairs, afraid to ride the elevators, a.k., "Mr. Toad's Wild Ride". I stopped, wheezing and gasping for breath, searching in my purse (which doubles as a tent in emergencies) for my inhaler. I got the sensation of being watched and began to hear what I assumed was the hissing of more heat. When I slowly turned, I saw about forty pairs of close-set beady eyes staring at me, forked tongues flicking, just waiting for the chance to spew poisonous venom! WTF kind of place IS this? Dogs draggin' ass down the hall, kids scraping mold off the walls to add flavor to their friggin' almond or whatever milk. Let me see someone get just one drop from milking a damn almond! I'd settle for seeing it's little almond teat! I digress. With my last breath, I crawled up them stairs double time like Regan in the crab version of the Exorcist, slammed the door and moved all the bureau's and armoire's and bidet's against the door! I sat on the floor and yelled "shoo, shoo"! at the top of my old leathery lungs and you can bet them bitches skeedaddled. I had to open a new box of Zinfandel, find my crazy straw and try to recover!
