Rocking the Oval Real Loud... or How To Spend Your Resources Wisely





If you live around the Oval--and even if you are buildings away--you will be hearing the loud noise coming from the Soul Asylum concert.

I eyed the crowds, and I'd say there were no more than 300 people present, at best.  A lot were spread out, in picnic style.  I thought the atmosphere was terrible, and left after I made my survey and took photos.

Surprise, surprise, but IDs were checked.  Not by Public Safety, but by an outside security force.  But, get this, one card holder could have 4 "guests," so all people had to do was ask someone going in with a STPCV ID to accept them as a guest.

Wondering How to Get In?

A lot of younger people had drinks in their hands, and I bet not apple or grape juice. No one checked. People who couldn't get in (or were trying to enjoy the Oval--good luck!) were sitting along the benches around the Oval.  The Oval Cafe was packed.

Aside from the outside security force, NYPD was also present!

A costly event.

Meanwhile basements in Peter Cooper Village lacking in washers and dryers have received used ones in stark, ripped to the bone basements that look as if they are from a HOSTEL film or some Russian contamination unit.  Careful when you go down there!

And be glad you even have this, because as CWCapital/CompassRock has informed tenants that these "services" do not need to be provided.  So aren't you glad about the priorities of where money is spent here?

That was one of the more obnoxiously loud and ugly-sounding events they have ever had. I called 311, but it did no good. The noise persisted until 6 pm and seemed to just get louder. Even the dogs were howling from the din. This is an outrageous violation of the zoning laws and Garodnick, et al can go fuck themselves next time they want my vote.

I live in Stuy Town. While I've been reading about the poor conditions in some PCV buildings, I didn't realize they looked like that. It looks terrible. To think they have a huge concert but can't use the money to expedite the repair is a freaking travesty. This place is getting worse and worse every day.

We live in 19 Oval. That damn concert was louder than anything that has ever been done in the past. Things were vibrating on the wall. I cannot believe they are not in violation of noise ordinances in New York City.

Maybe the TA could organize a street fair and concert in front of MacArthur's residence in Brooklyn.

Things must be pretty bad with Security if they need to have NYPD and a private security force to check IDs. Someone should research who owns the private security opeation and see who they know in this crap operation.

A discreet asbestos notice was placed in the glass case in the lobby. It consists of a diagram of the basement with the asbestos removal area circled. No official notice posted, no notice that removal was completed. But, hey, the machines are free.

The poor turnout was most likely due to the bad weather leading up to the concert. Soul Aslyum should be embarrassed to have played here, especially when Dave Pirner told the audience to stop by the leasing office. If this conert was really for residents, why would he be telling the to visit the leasing office? Hmmmm. How much did CWCaptial pay them for their appearance? The funds would have been better allocated towards laundry rooms.

That notice has been in my building for a month. There is a red line around the entire basement indicating where they plan to perform abatement.

How can it be safe for residents at the same time?

The temporary laundry rooms are clearly a reaction to the reduction in services complaint filed by the TA. In fact, one might see the outlines of management's response to that complaint in their opening sentences stating that machines were available in other buildings.

It seems to me that the reduction in services filing has them concerned.

I read on the TA Facebook page these washers/driers were filthy. Tenants had to clean them before using them.

They show nothing but contempt for us. Evil f***s.

The problem with this event was the timing. Most of the people who would have gone (myself included) were at Governor's Ball this weekend. Had they made it next weekend there would have been better attendance.

Coming home from shopping today , I passed a large pile of shit on the first ave loop and thought what I always think when I see that: about how nice things used to be around here years ago. Anyway, I get home and get the "community newsletter" under my door and saw two things of note. The first is that they are moving the management to the concierge area and expect work to be completed during Spring of 2014. Does this sound like a company that is getting ready to sell the property? For the purposes of full disclosure I always have been very pro conversion and felt that it was going to happen but can anyone really be optimistic at this point? I could imagine how CW must have been laughing to themselves watching all these TA meetings treating the conversion as a done deal and watching us hash out all the possible managerial options we would have once we were owners. The problem that I have personally is that without ownership, I'll never leave this place because I won't give up my apartment. I will never give them the satisfaction. I'll keep paying my real RS rent. As an owner, I probably would sell eventually and escape.

Another thing in the newsletter I found interesting was their response to dog owners wanting better signage as far as where dogs are allowed (or not). Has anyone ever seen and dog owners concerned that their dog may be pissing or crapping in an area they weren't allowed to? What is more unbelievable is that CW actually appears to be amenable to the idea of a dog run. They just "haven't yet identified the right space". It just keeps getting better and better.

If I recall correctly, it's hard to be certain of all the bondholders because the debt was sliced and diced into mortgage-backed securities. You can probably find the answer in Bagli's book. Still waiting to see the NYT report on the rentjacking, BTW.

But the fact is that everyone who received a mid-lease increase signed on the dotted line in acceptance. Granted, there might have been some sotto voice promises, but in contract law, you're bound by the 4 corners of the document. Sucks that CW is such a predatory landlord, but I think that a lot of FMR tenants in this position are simply realizing that they agreed to possibility of a rent increase.

Although FMR tenants signed leases saying the rent could go up in the middle of the lease, giving them 2 weeks to decide what to do about their apartment is just plain cruel (among other things), even if legal. It also does not show professional stewardship of the property, but of course we all know this already.

Weren't those mid-lease tenants given an extra 30 days to decide ? I thought it was bumped to July 1. Look, I agree it's a shitty way for the landlord to act, but unless the anon@3:55 PM is filing a motion before a judge to stop it, those tenants have some decisions to make.

Also would like to add, June 11, 2013 at 4:51 PM, that a number of people have it in writing (from agents in the leasing office) that mgmt would *never* exercise the mid-lease rent hike clause. Not to mention the scores of other concerned lease-holders who were told that to their faces.

So, a letter from the landlord modifying the terms of the lease (a promise to NEVER exercise a clause) and then having the landlord exercise said clause would be a breach of contract.

It would astound me to find out that they would have been that stupid to put such a thing in writing, but if they did, then that person has grounds to sue.

As far as the verbal promises, who has the time and money to fight that battle out in court ? CW will simply say no promises were made, and that everyone claiming that they were are simply jumping on the bandwagon to avoid paying the increase. Not going to happen in the time allotted. Might be grounds for another class action if you want to find a law firm who's looking for another $25++ million dollar payday and will be willing to part with your $150 dollar share of the winnings.

I'd love to know who the NUMBER of people are. DO you KNOW that for a fact or are you simply repeating rumors that you heard (from reliable sources)? I ask because Dan Garodnick AND the TA are desperate to locate even one or two more of THOSE people who did receive such promises in writing. It's extremely important to the entire issue as well as the execution of the mid-lease increases and their ultimate resolutions.

If you KNOW ANY of these people, please direct them immediately to the TA or Dan's office. If you're merely repeating gossip, albeit well-intentioned, please (and I mean this in the nicest way) shut the fuck up! Thank you.

CompassCrock hasn't yet set up an ad hoc company to rent retail space, so Rose is handling this. It's been reported elsewhere that part of the space is going to be a Starbucks (visuals on Rose retail site), but no sign of work yet. So get a nice hot coffee, jump on a Citi bike, and try not to spill it in your lap. Lawsuit!

Over on the TA fb page, there's someone who is always trying to control the content and direction of the discussions. Because there aren't a swarm of people joining in with the protesting outside the leasing office, this person preaches and scolds. Well, as far as I'm concerned it's up to the people with the mid-lease rent hikes to do whatever they are going to do and most of them are probably scrambling to find new homes, schools, etc. Most of us work and just don't have the time to plant ourselves outside the leasing office. We shouldn't have to be scolded and insulted because we can't be there. At least we can come to the STR blog without being preached at! Keep it up CAPS, if that's what helps you and if STR doesn't mind. We all need a place to vent without being lectured about it.

STR, I also commend that person for her activity at the leasing office, but nobody makes do it and if other people don't want to go that route it is their choice. You can't bully people into doing what you think is the right thing to do. And nobody loves an angry martyr!

I AM the person who has been accused of "controlling" the discussion and scolding. Sorry to bust your bubble, STR, but this is YOUR blog and this page a COMMENT BOARD so the rules & format are yours. I'd never presume to tell someone what to write or post & have seldom even posted here. When I HAVE it's almost always been a point of clarification OR simply an opinion. I believe I'm still entitled to one of those, regardless of what others may state.

Besides, control was never the point, I am more than aware that the rent-jacked among us have little time to protest downstairs. My last post merely instructed whoever wanted to do so (freelance) just how to do it. It ended with a statement of my disappointment, not s scold. There IS a difference. Can't imagine that statement would EVER have been interpreted as a scold unless it made some feel guilty? Then, I guess, if the shoe fits...

Never thought of that person as scolding. She just sounds fed up. For all of the complaining on all the STPCV boards it does seem like the same few people are the only ones to do anything about it. Maybe she makes a good point. Mostly I think she offers pretty good advice. Just like with CAPS, if you don't like it, don't read it

I think the ubiquity of the scold is the biggest problem with her. Make your point once, maybe twice - that's great. Make your point on every other post, every day for weeks, well, it's tiresome. Add the woman who discusses vomiting over the mid-lease increases every third post, when she's not decrying rent stabilization laws she clearly doesn't understand, and the board gets a little monotonous. I find useful information on the board, which is why I keep checking it, but at some point the conversation isn't so much a conversation anymore.

I's like to add that I watched 4children swinging like Tarzan on the hanging branches of 1 tree on the south-east side of the Oval. Public Safety did nothing, even after I told them of the harm the children were doing. The children even argued with me saying that the trees were not alive and could not feel anything. Their parents stood by engrossed in their own conversations.

I agree with you. I've been reading the TA Facebook page, and it doesn't seem that the moderators are failing to correct a lot of misinformation. The poster I believe you're referring to has been vomiting a lot of bad mojo towards other tenants that they seem to be blaming for their misfortune.

The apathy stems from several things. In the case of the negatively affected FMR tenants, I'd venture to say that the majority are licking their wounds and simply moving on, figuring that they'd be fighting a losing battle in the short term over leases that they agreed to, no matter if they were given false assurances. There's probably not enough time and money to deal with it, plus, think about how many of these lease holders are "dorm" apartments, where the prospect of a $500 or $1000 a month rent increase really means about $100 or $200 a month each when you split it between 4 people. Bet that's what CW is thinking, and really doesn't care if they're effectively evicting families who can't pay, because they'll just carve up the apartments and rent them to college kids.

As far as long time tenants, I'm surprised that there hasn't been more outrage by those affected by the pace of Sandy repairs, but I think most are just happy to be left the hell alone by management, and are grateful that the RS system continues to spare them from such ridiculous rental prices. Those that have lived in ST/PCV for decades can still remember the "all powerful Mother Met", and are often reluctant to show their unhappiness in public. Tenants were pretty much always at the mercy and the benevolence of the landlord. Through the years there was really only one politician (NYS Assemblyman Steve Sanders) who was able to accomplish much with Met. He was a thorn in their side, and partnered with the TA to give it some "bite" in the community. There was obviously more power to be had sitting in the State Chambers than in the City Council, who's leadership (Quinn) is simply a Bloomberg lap dog, held to the same real estate interests. Never forget how Bloomberg pissed on us during the original sale proceedings. I have little doubt that Quinn would do the same.

Excellent. Are you planning to speak? Even if you don't, it helps to have as many angry tenants there as possible. You can tell who they are--they're the ones NOT in the expensive suits.

For anyone who doesn't know, the final hearing takes place at a convenient nearby location--the Great Hall at Cooper Union. Come make a lot of noise in a space where Abraham Lincoln gave a speech. The festivities start at 6 p.m. on Thursday, June 20.

The mayor appoints 5 of the 9 RGB members, and since we've had republican mayors for the last 20 years, the RGB has always come in with fat increases for the landlords.

Maybe I haven't been paying enough attention, but I've yet to hear any of the current crop of democrat mayoral candidates commit to appointing RGB members that are a bit more tenant- friendly than the real estate execs that have sat in for 2 decades now. Or, pushing for the repeal of Urstadt, for that matter.

They all talk the "save the vanishing middle class" talk, but I wanna hear you promise you'll actually DO something about it.

Public testimony was taken at the June 13 RGB meeting. The June 20 meeting is the final vote, there will be no testimonies.

Advocates for tenants and for landlords urge people on their prospective sides to be present to hear the board deliberate (smirky face here) and to show them that this is important to them. You might also want to attend just to send a special farewell to Bloomberg's appointments to the board.

That said, the public testimony meetings of the last 12 years were a sideshow featuring an endless parade of tenants and a few mom and pop landlords from Queens spilling their guts for the board. The real action took place in whatever restaurant that Mayor Bloomberg had lunch with whatever titan of the NYC real estate industry on any particular day.

12 years of Pataki followed by 12 more of Bloomberg have been brutal to tenants. Hopefully we've wised up, but we'll see.

Have to correct some of what's been just said: All nine members of the RGB are appointed by the mayor. From the RGB website:

"The RGB consists of nine members, all of whom are appointed by the Mayor. Two members are appointed to represent tenant interests. One of these serves a two-year term, and the other a three-year term. Two members are appointed to represent owner interests. Like the tenant members, one serves a two-year term, and the other a three-year term. Five members (including the chairperson) are appointed to represent the general public. One of these serves a two-year term, another a three-year term and two serve four-year terms. The chairperson serves at the pleasure of the Mayor."

People can speak at the final meeting. Showing up and letting the RGB know what you think--in front of the TV cameras--demonstrates that you're willing to fight.

Anyone who wants to know what the next mayor might do should ask at the TA's mayoral forum.
